
Under the provisions of the Planning and Compulsory Purchase Act 2004, policies in the High Peak Local Plan (adopted 31 March 2005) were valid for a period of three years. Local Planning Authorities were invited by the Department for Communities and Local Government (DCLG) to make an application to the Secretary of State to issue a direction to save selected Local Plan policies beyond this 3-year period.
DCLG set out in a protocol the broad principles to save selected Local Plan policies. Local Planning Authorities needed to demonstrate that the policies to be saved:
The schedule of those policies in the High Peak Borough Local Plan that required saving in accordance with the protocol, was submitted to the Secretary of State for consideration on 25 September 2007. In a 'Direction' letter from the Government Office of the East Midlands (GOEM) dated 26 March 2008, the Secretary of State approved the submitted Saved Policies Schedule.
The Secretary of State’s Direction came into effect on 31 March 2008 and accordingly all Local Plan policies not saved cease to have Development Plan status as of the 30 March. Saved Local Plan policies now need to be read alongside the adopted Regional Plan and adopted Development Plan Documents as they emerge. In time, emerging Local Development Framework DPD’s will replace most Local Plan policies.
A Saved Policies Local Plan has now been issued. This document contains only those policies that continue to form part of the development plan. All other policies have been deleted and will cease to be considered during the determination of planning applications.
The Council has to prepare and keep under review the High Peak Local Plan. This sets out the planning policies for the whole of the High Peak outside the Peak District National Park. The published Local Plan is used as a basis for assessing planning applications.

The High Peak Interim Housing Policy Statement (159KB)
came into affect on Friday 2 January 2009. The statement is intended to clarify the Council’s interim approach to residential applications in light of the emerging Regional Spatial Strategy for the East Midlands, in particular the Secretary of State’s Proposed Changes released in July 2008. Whilst the document does not represent an alteration in policy, it does signal a change in way that Development Plan policy is interpreted and applied in parts of High Peak. As such, the document should be read in conjunction with relevant policies of the Saved High Peak Local Plan.
The Derbyshire Structure Plan (399KB)
, together with the High Peak Local Plan, forms most of the development plan for the areas of the Borough outside the Peak Park. The Structure Plan sets the broad planning policies for the area and is prepared by Derbyshire County Council.
In March 2007, applications were made to the Secretary of State under the provisions of Schedule 8 of the Planning and Compulsory Purchase Act 2004, to save certain policies of the Derby and Derbyshire Joint Structure Plan and Derby and Derbyshire Minerals Local Plan beyond their expiry date of 27 September 2007.
The County Council has now been notified by the Government Office for the East Midlands that the Secretary of State has directed that all of the policies listed in each schedule attached will be saved for a further period. In the case of the Joint Structure Plan, the policies will be saved until the East Midlands Regional Plan is approved in autumn 2008. In the case of the Minerals Local Plan, the policies will be saved until they are replaced by new Development Plan Documents in due course.
